Refund & Cancellation Policy
1. General Overview
This Refund & Cancellation Policy outlines the rights of
users regarding refunds for services and products offered by The Learning
Chimp (Pty) Ltd ("we", "us", "our") through
the website www.thelearningchimp.com.
This includes online courses, coaching, tutoring, subscriptions,
certifications, downloadable content, and other related services. This policy
is binding on all users, including learners, instructors, tutors, coaches,
affiliates, and visitors aged 18 and over.
By using our platform, you agree to this Refund &
Cancellation Policy in conjunction with our Terms and Conditions and Privacy
Policy.
2. Eligibility for Refunds
Refunds may be requested under the following conditions:
- Self-Paced
Courses: Learners may request a full refund within 3 calendar days
(72 hours) of purchase provided the course has not been completed
or substantially consumed (more than 25% progress or full download of
materials).
- Subscription-Based
Content: Subscriptions may be cancelled at any time. Refunds will not be issued for partially used periods. Access continues until the end of
the billing cycle.
- Coaching,
Tutoring, and Live Classes: Refunds for 1-on-1 or group
coaching/tutoring sessions are applied as follows:
- If
the learner cancels at least 4 hours in advance, an 80% refund
will apply if approved by our admin team.
Should the learner cancel less than 4 hours before the scheduled
time, no refund will be applicable.
- Should
a learner not show up for a scheduled lesson (i.e "no-shows”), they will
not be eligible for a refund.
- For
late arrivals, where a learner arrives late for a lesson, the lesson will
continue for the remaining duration of time scheduled. The tutor is not
obligated to make up the lost time, nor is the tutor obliged to postpone
or cancel the session. No refund
will apply and the full lesson fee is applicable.
- If
an instructor arrives late, they must compensate the learner by either
extending the session or rescheduling to make up for lost time. If this
is not feasible, the learner will receive a proportional refund.
- Instructors
must provide at least 4 hours’ notice if they wish to cancel or
reschedule a lesson. Failure to do so may result in a fee or account
suspension.
Packages and multiple sessions
Refunds in these instances will
be apportioned, based on the number of sessions already used or courses already
consumed.
- Downloadable
Materials and Certifications: These are non-refundable once
accessed or downloaded, due to their digital nature.
- Learnership
Programs: These may include separate terms and refund policies as
governed by partner institutions or SETA requirements. Refer to specific
learnership documentation.
- Affiliate
Earnings: Affiliates are not entitled to refunds on purchases they
promote but may raise commission-related disputes within 30 days of
payout.
- Refunds
for items or services issued on promotion or at a discount: No refunds will be issued unless
the terms of the promotion or discount stipulate otherwise.
3. Refund Process
To request a refund:
- Email
us at info@thelearningchimp.com with the subject "Refund Request –
[Your Full Name]”.
- Include
the reason for your request, course or service name, and proof of payment.
- A
refund is not guaranteed. The
request will first need to be evaluated and a decision will be made within
7 business days. The outcome will be communicated to you via email.
We aim to process valid refund requests within 7-14
business days. Refunds will be returned to the original method of payment.
For non-South African customers, third-party platform timelines (e.g., PayPal,
Stripe) may affect processing time.
4. Payment Channels
- South
African stakeholders: Payments are processed directly through local
banking platforms or payment gateways supported by South African banks.
- International
stakeholders: Payments are processed via approved third-party channels
(e.g., PayPal, Paystack, Stripe, etc.).
5. Exceptions and Discretion
- Refunds
are issued at the sole discretion of The Learning Chimp (Pty) Ltd
in situations not covered above.
- Abuse
of refund requests, fraud, or violation of our Terms may result in account
suspension and forfeiture of refunds.
6. Changes to This Policy
We reserve the right to modify this Refund &
Cancellation Policy at any time. Changes will be communicated via our website.
Continued use of our services after changes constitutes acceptance of the
updated terms.
7. Governing Law and Jurisdiction
The Terms of this policy are governed by and construed under
the laws of the Republic of South Africa.
You consent to the exclusive jurisdiction of the South
African courts in respect of any legal proceedings arising from these Terms or
your use of the Website or Services.
