Affiliate Terms and Conditions
1. Introduction
These Affiliate Terms and Conditions ("Agreement") govern your participation in the affiliate program ("Affiliate Program") offered by The Learning Chimp (Pty) Ltd ("The Learning Chimp”, "we", "our", or "us") though our wesite www.thelearningchimp.com("Website"). By participating, you ("Affiliate”, "you”, or "your”) agree to be bound by this Agreement.
The Learning Chimp Affiliate Program enables you to promote our platform, including courses, group classes, and private lessons. You will earn a 10% commission on qualifying purchases made via your unique referral links.
By registering as an affiliate, you agree to be bound by these Affiliate Terms, our general Terms and Conditions, Privacy Policy, and any additional policies referenced herein.

2. Eligibility

Note: You may not use the same email address to register as an affiliate and as a learner or teacher. Separate accounts must be used for different roles on the platform.
3. Commission and Payments
· Affiliates earn 10% on all referred purchases (courses, group classes, and lessons).
· Commissions are calculated on the net sale amount, excluding VAT or other taxes.
· Commissions are paid out monthly once your balance reaches a minimum of R100 or $10.

6. Restrictions
· You may not refer yourself or use your link to make purchases.
· You may not use misleading claims, spam, or false advertising. You may not design, develop, or operate any website, social media page, advertisement, or other promotional material that replicates, imitates, or gives the impression of affiliation with The Learning Chimp’s official website, brand identity, or user interface. This includes, but is not limited to, duplicating the look and feel, layout, design elements, or language of The Learning Chimp’s digital properties. Affiliates may not copy or use textual content from The Learning Chimp’s website verbatim, except when accurately quoting course titles or descriptions for promotional purposes.
· You are not permitted to utilise, distribute, or include any spyware, malware, viruses, or other malicious or unauthorised software in connection with Referral Links, banners, or any other promotional content. All software and downloadable content must be expressly and transparently disclosed, and shall require affirmative, informed consent from the end user prior to download or installation on any device.
· Do not impersonate The Learning Chimp or misrepresent your relationship with us. You must clearly and truthfully disclose the nature of your relationship with The Learning Chimp in all promotional communications. You will not misrepresent your status or imply any formal employment, agency, joint venture, or other partnership with The Learning Chimp.
· You are not authorised to bind The Learning Chimp to any agreement or obligation.
· Framing, cloning, or scraping of our website is strictly prohibited.
· You are not permitted to use Our company name, or any variation or misspelling thereof, in your domain names or on social media pages.
· You are solely responsible for all content on your website. You may not promote Our content or Our instructors’ courses on any website that contains misleading, defamatory, obscene, illegal, hateful, pornographic, or otherwise offensive material, as determined by our sole discretion.
· You are permitted to create original promotional content using The Learning Chimp’s publicly available course pages as reference. Use of official course images and brief excerpts of descriptive content is allowed for accurate and lawful promotion. However, under no circumstances may you copy, download, republish, or redistribute any proprietary materials, including video content (whether paid or free), downloadable resources, quizzes, lesson plans, or supplementary educational materials, on your website(s) or any other platform.
· The Affiliate Program is designed to reward affiliates who actively promote The Learning Chimp’s paid offerings. Affiliates whose activity is determined to consist primarily—defined as more than 50% of referred enrollments—of free course promotions, or whose conduct undermines the purpose or integrity of the program, may have their accounts suspended or terminated at the sole discretion of The Learning Chimp, without prior notice. The Learning Chimp offers both free and paid courses. Referrals that result in enrollments in free courses, or in which a promotional code is used to access a paid course at no cost, are not eligible for affiliate commission. These enrollments will not be recorded in the affiliate’s account, and no commission will be payable.

All content, branding, and trademarks of The Learning Chimp remain the exclusive property of The Learning Chimp (Pty) Ltd. You may only use marketing materials provided in the affiliate area or with written permission.
9. Termination and Suspension
We reserve the right to suspend or terminate your affiliate account at any time, without prior notice, for any of the following:
· Violation of these terms
· Fraudulent activity or abuse of the system
· Inactivity for six (6) consecutive months
· Behaviour that damages our reputation or operations
Upon termination, you must immediately cease promotion and remove all affiliate links and materials.
You may terminate your relationship with us at any time by notifying us via email. Upon termination, any outstanding payouts due to you will be processed in the next cycle, subject to any applicable deductions.
10. Disclaimers and Limitation of Liability
The platform is provided "as is" without any warranties. The Learning Chimp does not guarantee income.
We are not liable for indirect, incidental, or consequential damages, including loss of income or data, arising from your participation in the affiliate program.
12. Governing Law and Jurisdiction
These Affiliate Terms are governed by the laws of the Republic of South Africa.
By using the Website, you consent to the jurisdiction of the South African courts in the event of any dispute.

We may modify these Affiliate Terms from time to time. Continued use of the Website and Services after changes have been made constitutes acceptance of the updated terms.
