Instructor Terms and Conditions


1.     Introduction

Welcome to The Learning Chimp (Pty) Ltd ("The Learning Chimp", "we", "us", "our"). These Instructor Terms and Conditions ("Instructor Terms") govern your participation as an instructor on our website, www.thelearningchimp.com("Website").

An Instructor is defined as any individual who develops educational content, presents courses, provides coaching, or offers tutoring through the platform. This includes course developers, presenters, coaches, and tutors.

By using the Website to publish, sell, or deliver educational content or services, you agree to be bound by these Instructor Terms, our general Terms and Conditions, Privacy Policy, and any additional policies referenced herein.

2.     Eligibility

To become an Instructor on The Learning Chimp, you must:

  • Be at least 18 years of age.
  • Have the legal capacity to enter into contracts.
  • Provide accurate personal and professional information during registration.
  • Comply with applicable laws and policies.

We reserve the right to verify your credentials and approve or deny Instructor status at our sole discretion.

3.     Technical Requirements

·        To deliver live sessions, you need a stable internet connection - ideally 5Mbps+ download/upload for HD video and live sessions .

·        A webcam (built‑in or USB) and microphone/headsetfor clear video/audio recording and live teaching

4.     Instructor Responsibilities

As an Instructor, you agree to:

  • Create and maintain high-quality educational content (courses, group classes, coaching sessions, etc.);
  • Ensure content is original, lawful, and does not infringe on any intellectual property rights;
  • Respond to learner queries and provide reasonable support;
  • Keep course information and schedules up to date;

·        Maintain professional conduct in all communications.  All communication and interactions with learners must be handled with respect.

·        Use the platform’s communication tools for educational and operational purposes only.

You must not:

  • Post misleading, harmful, or offensive content;

·        Discriminate against any user; Any form of harassment, discrimination, or immoral behavior is strictly prohibited and will result in immediate removal from the platform.

  • Solicit learners to other platforms.

5.     Prohibited Course Content

To maintain the integrity, safety, and inclusivity of The Learning Chimp platform, all instructors must agree not to upload, share, or promote content that includes or relates to the following prohibited topics:

a)     Illegal or Criminal Activity

Instructors may not publish content that teaches, encourages, or facilitates:

·        Hacking, phishing, or digital fraud

·        Counterfeiting, identity theft, or document forgery

·        Piracy or the distribution of copyrighted materials without permission

·        Manufacture, sale, or use of illegal weapons, explosives, or substances

·        Any other activity deemed illegal under South African or international law

b)     Violence, Harm, or Abuse

The following are strictly prohibited:

·        Content that promotes or glorifies self-harm, suicide, or eating disorders

·        Depictions or encouragement of physical, sexual, or emotional abuse

·        Violence against any individual, group, or species

c)     Hate Speech and Discrimination

Content that discriminates against or incites hatred toward individuals or groups based on the following is not allowed:

·        Race, ethnicity, or nationality

·        Religion or belief

·        Gender, sex, or sexual orientation

·        Disability, neurodivergence, or health status

·        Age, socioeconomic status, or political affiliation

d)     Sexually Explicit or Inappropriate Content

The platform prohibits:

·        Pornographic or sexually explicit material

·        Courses focused on sexual acts or adult entertainment

·        Inappropriate nudity or sexually suggestive content not aligned with educational

e)     Medical and Health Misinformation

Instructors may not provide or claim to provide:

·        Medical diagnoses, treatments, or cures

·        Anti-vaccination content or unverified health claims

·        Advice that could reasonably be interpreted as professional medical guidance without proper licensing

f)       Terrorism, Extremism, or Radicalisation

Any course that glorifies, recruits for, or instructs on:

·        Terrorist activity or ideologies

·        Violent extremism or politically motivated violence

g)     Conspiracy Theories and Disinformation

The Learning Chimp does not allow:

·        Theories with no scientific or factual basis presented as truth

·        Misinformation about health, science, elections, or major world events

h)     Unlicensed Financial, Legal, or Investment Advice

Courses may not:

·        Provide tax, legal, or investment advice unless the instructor is properly certified

·        Make unrealistic financial promises, including "get-rich-quick” or pyramid-style schemes

i)       Plagiarised or Unauthorised Content

All course content must be original or used with express permission. Prohibited:

·        Uploading third-party content without proper licensing

·        Using AI-generated content without human moderation and original input

·        Copying from books, websites, or courses without citation or permission

j)       Gambling, Betting, or Substance Use

Courses may not:

·        Promote or teach betting, lotteries, or online gambling

k)     Overt Religious or Political Proselytizing

Courses must not:

·        Seek to convert learners to a specific religious or political ideology

·        Attack or mock opposing beliefs or viewpoints

l)       Inappropriate Promotional Content

·        Courses designed primarily to promote external products, services, or brands will be rejected

·        Instructors may mention external offers only when relevant, transparent, and value-based

Enforcement and Penalties

·        Violations may result in immediate removal of content, instructor account termination, and forfeiture of earnings.

·        The Learning Chimp reserves the right to determine what content violates these policies and to update the list of prohibited topics without prior notice.

6.     Revenue and Commission

  • You will receive 80% of the net revenue from course sales, tutoring sessions, and coaching services provided via the platform.
  • The Learning Chimp will retain a 20% commission on all successful transactions.
  • "Net revenue" refers to the total amount received from learners, less any applicable taxes, refunds, cancellations or third-party processing fees.
  • Please familiarise yourself with the Refund and Cancellation Policy to understand when they will be applied.

7.     Payment Processing

  • For South African Instructors, payments will be processed directly through local banking systems.
  • For Instructors outside South Africa, payments will be processed via third-party payment processors.
  • Payouts will be released once a month on the last day of the month (at no specific time), provided the minimum payout threshold of R100 or $10 has been met.
  • The last day of the month is determined using the South African days and time zone (GMT+2).  Unless otherwise communicated, should the last day of the month fall on a Saturday or Sunday, payment will be released the Friday before.
  • You MUST initiate a withdrawal request from your profile, in order to qualify for payment.  Requests must be made by the 10th of the month, to qualify for payment by the end of that month.  Any withdrawal request received after the 10th will be processed at the end of the following month. 
  • A 4% transaction fee will apply to all payouts.
  • It is your responsibility to provide accurate and up-to-date banking or payout information on your Instructor profile on the platform.
  • The instructor must ensure their banking details are correct at all times on their profile in the system. We will only use the payment details supplied on your profile, on the system. Any payment information sent via email or alternative communication channels will not be considered.
  • The Learning Chimp will not be held liable for any incorrect or failed payments resulting from missing or inaccurate payment details supplied by the Instructor.
  • Instructors are responsible for any charges or deductions incurred by their bank or payment gateway as a result of receiving payouts.

8.     Content Licensing and Ownership

You retain ownership of the content you create. However, by uploading content to The Learning Chimp, you grant us a worldwide, non-exclusive, royalty-free license to use, display, distribute, market, and sublicense the content solely for the purposes of operating and promoting the platform.

We may remove content that violates our policies or applicable laws.

9.     Taxes and Legal Compliance

You are responsible for:

  • Complying with local tax laws, including VAT or income declarations;
  • Ensuring you are legally allowed to offer instruction, coaching, or services;
  • Managing your own tax submissions.

The Learning Chimp may provide documentation for income earned on the platform upon request.

10.  Lessons and Discussions

·        Scheduling of Lessons

Lessons must be scheduled and confirmed using the website's booking system.

·        Cancellation by Instructors: Instructors must provide at least 4 hours’ notice if they wish to cancel or reschedule a lesson. Failure to do so may result in a fee or account suspension.

·        Arriving Late

If an instructor arrives late, they must compensate the learner by either extending the session or rescheduling to make up for lost time. If this is not feasible, the learner will receive a proportional refund.

·        No-Shows

If an instructor fails to show up for a scheduled lesson without providing prior notice, the learner will receive a full refund. Repeated no-shows may lead to account suspension or termination.

11.  Termination and Suspension

The Learning Chimp reserves the right to suspend or terminate your Instructor account if:

  • You violate these Instructor Terms or general Terms and Conditions;
  • You receive repeated negative feedback from learners;
  • You fail to deliver services as promised.

You may terminate your relationship with us at any time by notifying us via email. Upon termination, any outstanding payouts due to you will be processed in the next cycle, subject to any applicable deductions.

12.  Disclaimers and Limitation of Liability

The platform is provided "as is" without any warranties. The Learning Chimp does not guarantee income or learner outcomes.

To the extent permitted by law, The Learning Chimp shall not be liable for indirect or consequential losses, including lost earnings or reputation damages.

13.  Governing Law and Jurisdiction

These Instructor Terms are governed by the laws of the Republic of South Africa.

By using the Website, you consent to the jurisdiction of the South African courts in the event of any dispute.

14.  Amendments

We may modify these Instructor Terms from time to time. Continued use of the Website and Services after changes have been made constitutes acceptance of the updated terms.
